Nepal's Trishuli Flash Flood: Ice-Rock Avalanche, Cryosphere Hazards, and Cross-Border Disaster Governance

A massive flash flood on August 26 killed at least 157 people in Nepal's Rasuwa district — with over 400 missing, including 133 Indians — after what scientists suspect was an ice-rock avalanche that blocked and then burst the Lhende Khola, sending a debris surge through the Bhote Koshi and Trishuli river systems.

◈ Background & Context

The Bhote Koshi–Trishuli river system originates on the Tibetan Plateau and flows south through Nepal's Rasuwa and Nuwakot districts before joining the Gandak system.

The basin straddles the Nepal-China border and has a documented history of Glacial Lake Outburst Floods (GLOFs) and ice-avalanche-triggered floods — including a glacial lake outburst in the same river on July 8, 2025.

  • The flood struck at approximately 9:00 AM on August 26; water levels on the Trishuli at Galchchi reportedly rose 9 metres in 30 minutes; at Malekhu, levels rose 7 metres in a similar period — indicative of a dam-burst rather than rainfall runoff.
  • The event damaged 19 motorable bridges, 40 km of road, multiple hydrological monitoring stations, and several hydropower facilities along the Bhote Koshi system. Around 430 MW of electricity supply — approximately one-eighth of Nepal's installed capacity — was disrupted.

ICIMOD scientists have noted that "the increasing frequency of cryosphere hazards is becoming more visible than ever before — the pace of change is so rapid that current efforts are struggling to keep up." In 2025 alone, ICIMOD recorded three GLOF/cryosphere-origin floods in the HKH region in just two months (Nepal, Afghanistan, Pakistan).

OBC Creamy Layer, the Supreme Court's March 2026 Verdict, and the "Rules of the Game" Doctrine in CSE-2025

The Supreme Court has agreed to constitute a Special Bench to hear the Centre's plea on whether its March 2026 verdict redefining OBC creamy layer criteria applies retrospectively to the already-concluded CSE-2025 — crystallising a fundamental tension between judicial correction of discriminatory policy and the "rules of the game" doctrine in service law.

◈ Background & Context

The OBC creamy layer — the sub-category of Other Backward Classes who are economically and socially advanced enough to be excluded from reservation benefits — has been defined by a series of government orders and court judgments since the Mandal Commission implementation in 1992.

  • 1993 OM (Office Memorandum): Established the original creamy layer criteria. Crucially, it excluded income from salary and agricultural sources from the income/wealth test — meaning government servants' and farmers' children could still claim OBC reservation.
  • 2004 DoPT Clarification: Said that salary income of employees in PSUs and the private sector would count as a criterion for creamy layer — subjecting PSU/private sector employees' children to the income test. This was applied rigorously only from CSE-2015 onwards.
  • Since 2015, about 100 candidates who held valid caste certificates and cleared the CSE had their OBC claims rejected by DoPT on creamy layer grounds — most of them children of PSU/private sector employees, who argued this was discrimination vis-à-vis children of government servants (whose salary was excluded).
  • SC Verdict (March 11, 2026): The Supreme Court ruled that income cannot be the sole criterion for determining creamy layer status among OBCs — effectively striking down the asymmetry created by the 2004 clarification. It set a six-month implementation deadline (September 11, 2026).

  • OBC Creamy Layer: Concept introduced by the SC in Indra Sawhney v. Union of India (1992) — the apex court held that the "advanced sections" of OBCs should be excluded from reservation to ensure benefits reach the truly backward. The government determines the income/wealth threshold periodically.
  • "Rules of the Game" Doctrine: A settled principle in service law — the criteria governing a selection or recruitment process cannot be changed mid-process or after the process concludes. Established in Tej Prakash Pathak v. Rajasthan HC (2024): "criteria for selection cannot be altered by the authorities in the middle or after the process of selection has commenced."

The Core Dispute — Why the Centre Approached the SC

CSE-2025 final results were announced five days before the March 11 SC verdict. The Centre argues that at the time of the exam, shortlisting, interviews, and result declaration, the 2004 DoPT clarification was the operative law — candidates participated and planned under those rules.

  • If the SC verdict is applied retrospectively, category-wise merit lists would have to be redrawn — some candidates previously deemed creamy-layer (and denied OBC reservation) would now qualify, potentially displacing candidates who were selected under the old criteria.
  • The Centre warns of cascading effects: revised ranks → altered cadre allocations → disrupted training batches → seniority and pay fixation anomalies.
  • The Centre cites the Divjot Sekhon precedent: even when a rule is found unlawful, relief need not unsettle completed processes where large numbers of third parties are affected and not before the court.
Why This Is Constitutionally Significant
  • The case raises a fundamental question: when a court corrects a discriminatory policy, who bears the cost of correction — the system, the beneficiaries of the earlier (flawed) process, or the state?
  • The 100 candidates denied OBC status under the 2004 clarification across multiple exam cycles represent a distinct injustice — but remedying it in the context of CSE-2025 specifically may not serve them if those candidates did not appear in or qualify CSE-2025.

Heatwaves as Notified Calamities: Disaster Finance Unlocked, But Implementation Must Follow

MHA's August 4 notification adding heatwaves to India's list of 14 officially notified natural calamities removes a critical financing asymmetry — but analysts warn that the real bottleneck is now planning and implementation capacity, not the availability of funds.

◈ Background & Context

India's disaster finance architecture is structured around the Finance Commission's recommendations under Article 280 of the Constitution. The 16th Finance Commission (FC-XVI) recommended ₹2.04 lakh crore for State disaster funds over 2026-27 to 2030-31 — 28% more than the previous commission's allocation.

  • SDRF (State Disaster Response Fund): ₹1.6 lakh crore of the total; for immediate response, relief, and reconstruction after a disaster. Centre contributes 75% for general states, 90% for special category states (Northeast + Himalayan).
  • SDMF (State Disaster Mitigation Fund): The remaining ~₹44,000 crore; for longer-term risk reduction — cooling shelters, early warning systems, hazard-resilient construction.

A westward-to-eastward moving western disturbance combined with sustained monsoon rainfall over the southern Himalayan foothills and southern Tibet may have primed the hydrological system before the August 26 Nepal flash flood, according to IMD's D.S. Pai.

Southern Tibet reportedly experienced moderate-to-heavy rain with localised intense downpours. A monsoon depression over northern India was expected to continue bringing heavy rain to Nepal for three more days.

  • Prelims hook: A western disturbance is an extratropical storm originating over the Mediterranean Sea and Caspian Sea regions, travelling eastward along the jet stream; it normally brings winter/pre-monsoon rain to northwest India but can interact with the monsoon when it moves to the eastern Himalayas.
